DOMAIN REVOCATION POLICIES

This page is a work in progress. Additional registrars will be added
as they become operational and post their domain name dispute policies.

ICANN's proposed Uniform Domain Name Dispute Resolution Policy will be considered for adoption at ICANN's Annual Meeting in Los Angeles on November 4, 1999. The revocation text of ICANN's Statement of Registrar Accreditation Policy adopted March 4, 1999 is posted below.

DRAFT UNIFORM DOMAIN NAME DISPUTE RESOLUTION POLICY

3. Cancellations, Transfers, and Changes. We will cancel, transfer or otherwise make changes to domain name registrations under the following circumstances:

  1. subject to the provisions of Paragraph 8, our receipt of written or appropriate electronic instructions from you or your authorized agent to take such action;
  2. our receipt of an order from a court or arbitral tribunal, in each case of competent jurisdiction, requiring such action;
  3. our receipt of a decision of an Administrative Panel requiring such action in any administrative proceeding to which you were a party (as explained in Paragraph 4 below); and/or
  4. to comply with the resolution of a dispute concerning your domain name under another registrar's domain name dispute resolution policy that is identical to this policy in all material respects.

We may also cancel, transfer or otherwise make changes to a domain name registration in accordance with the terms of your Registration Agreement or other legal requirements.

7. Maintaining the Status Quo. We will not cancel, transfer, activate, deactivate, or otherwise change the status of any domain name registration under this Policy except as provided in Paragraph 3 above.

J. Business Dealings, Including with SLD Holders:

i. The SLD holder shall agree that its registration of the SLD name shall be subject to suspension, cancellation, or transfer by any ICANN procedure, or by any registrar or registry administrator procedure approved by ICANN, (1) to correct mistakes by the registrar or the registry administrator in registering the name or (2) for the resolution of disputes concerning the SLD name.

The registrant agrees that A+Net shall have the right in its sole discretion to revoke, suspend, transfer or otherwise modify a domain name registration upon thirty (30) calendar days prior written notice, or at such time as A+Net receives a properly authenticated order from a court of competent jurisdiction, or arbitration award, requiring the revocation, suspension, transfer or modification of the domain name registration.

15.Breach. The registrant's failure to abide by any provision under this Policy may be considered by A+Net to be a material breach and A+Net may provide a written notice, describing the breach, to the registrant. If, within thirty (30) calendar days of the date of such notice, the registrant fails to provide evidence, which is reasonably satisfactory to A+Net, that it has not breached its obligations, then A+Net may revoke registrant's registration of the domain name. Any such breach by a registrant shall not be deemed to have been excused simply because A+Net did not act earlier in response to that, or any other, breach by the registrant.

9. Breach and Revocation. Any breach by you of this Agreement or the Dispute Policy must be remedied by you within 30 days of notice by CORE. If you fail to cure the breach, CORE may revoke your registration of the domain name.

You also agree that CORE shall have the right in its sole discretion to revoke, suspend, transfer or otherwise modify a domain name registration upon seven (7) calendar days prior written notice, or at such time as CORE receives a properly authenticated order from a court of competent jurisdiction, or arbitration award, re-querying the revocation, suspension, transfer or modification of the domain name registration.

Spam Policy: We reserve the right, in extreme circumstances, to revoke without refund any domain name (services E-mail Forwarding/Domain Forwarding) which, in our judgement, has been used for any unlawful purpose, including theft of email service, or as a source of unsolicited bulk email or as an address to use for replying to unsolicited bulk email.

. . . 5. Domain Direct will attempt to avoid the registration of domain names that are potentially disputable, but will not be held responsible in the event that a dispute does arise. Domain Direct is entitled to reject an application which Domain Direct considers as being unsuitable or likely to be involved in a trademark dispute.

. . . The applicant acknowledges that any third party may, for whatever reason, challenge the use by the applicant of the domain name before an Administrative Domain Name Challenge Panel (ACP) in accordance with the WIPO ACP rules. The applicant further acknowledges that the decisions of an ACP may determine rights of applicant or other parties or both to the use of a particular domain name, and that, with respect to its right to use a particular domain name or names, it will be bound by ACP decisions.

14. Revocation. Registrant agrees that Melbourne IT may delete a Registrant's domain name if this Registration Agreement, or subsequent modification(s) thereto, contains false or misleading information, or conceals or omits any information Melbourne IT would likely consider material to its decision to approve this Registration Agreement.

17. Suspension, Cancellation, Transfer. Registrant agrees that registration of its domain name shall be subject to suspension, cancellation or transfer by any ICANN procedure, or by any registry administrator procedure approved by ICANN policy:

6. What about this term in your Registration Agreement that "you agree that we may, in our sole discretion, delete or transfer your domain name at any time"?

We hope we will never have to use this term. It is in our Registration Agreement simply to enable us to take action if we find no other way to correct something that we feel needs correction.

All domain name registrations that you order through NetNames are subject to the following agreements. The first is an agreement between you and NetNames. The other is the agreement between you and the Network Information Center (NIC) or other similar organization responsible for overseeing the top level domain under which you are seeking to register a domain. When you order a domain name through NetNames, you must agree to The terms and conditions of both NetNames and the relevant organization that grants the domain name that you are seeking. If you contravene the terms and conditions of either NetNames or the relevant NIC, your domain could be suspended or deleted and other Liabilities may follow. Any controversy or claim arising out of or relating to this agreement or any breach thereof will be settled by arbitration in the State of New York, County of New York; in accordance with the rules and regulations of the American Arbitration Association. The Customer and Provider agree to be bound by the award in arbitration and judgment upon the award rendered by the arbitrator(s) may be entered in any court of competent jurisdiction. The prevailing party will be entitled to reimbursement for costs, disbursements, and reasonable attorneys' fees.

C. Dispute Policy. Registrant agrees, as a condition to submitting this Registration Agreement, and if the Registration Agreement is accepted by NSI, that the Registrant shall be bound by NSI's current Dispute Policy.

M. Right of Refusal. NSI, in its sole discretion, reserves the right to refuse to approve the Registration Agreement for any Registrant. Registrant agrees that the submission of this Registration Agreement does not obligate NSI to accept this Registration Agreement. Registrant agrees that NSI shall not be liable for loss or damages that may result from NSI's refusal to accept this Registration Agreement.
